Welcome to Clausette. These Terms of Service govern your access to and use of the Clausette mobile application, website, backend services, AI features, subscriptions, and related services.

By creating an account, purchasing a subscription, or using Clausette, you agree to these Terms. If you do not agree, do not use the service.

1. The Service

Clausette is a wardrobe and styling app that lets you:

• Organise clothing items in a digital closet, adding items by photographing them or by extracting them from a photo of an outfit
• Build outfits and save them
• Log your outfit of the day (OOTD) and track streaks
• Generate a personalised AI fashion doll from body photos you upload
• Run virtual try-ons of items from your closet
• Receive AI-assisted styling suggestions, occasion outfits, and purchase compatibility scores
• Save inspiration to a dream closet, build packing-list edits, and browse a year-in-review (Wardrobe Wrapped)
• Connect with friends, send and receive borrow requests for clothing, and coordinate group looks in Style Circles
• Receive in-app and push notifications for the events above

Several features use AI and may require uploaded photos, wardrobe items, and explicit AI processing consent.

2. Eligibility and Accounts

You must be at least 13 years old and legally able to enter into these Terms to use Clausette. At sign-up you confirm that you are at least 13 years old and that you agree to these Terms and our Privacy Policy.

If the law where you live requires a higher age or parental consent for users under 16 (for example, certain EU member states under the GDPR), you must satisfy that requirement before using the app.

You are responsible for:

• Providing accurate account information
• Keeping your sign-in credentials secure
• All activity that happens under your account
• Making sure you have the rights and permissions needed for content you upload

You may sign in using email, Apple, or Google.

You agree that the email address you use to create your Clausette account is one you control. If you use an email address belonging to another person without authorization, your account may be terminated and the email released to its rightful owner upon verification of ownership through a supported single sign-on provider (Apple or Google) or other reasonable proof. Subscriptions purchased on a terminated account remain billable until cancelled with the payment processor (Apple or Google) and are not automatically refunded by Clausette.

3. User Content

"User Content" means content you upload, create, save, or share in Clausette, including photos, wardrobe items, outfits, OOTDs, notes, style preferences, profile information, messages and notes attached to social features, generated images, and social activity.

You keep ownership of your User Content. You grant Clausette a worldwide, non-exclusive, royalty-free licence to host, store, copy, process, transform, display, and use your User Content only as needed to operate, improve, secure, and provide the service and features you request.

You must not upload content that:

• You do not own or have permission to use
• Includes another person's body, face, wardrobe, or private information without their permission
• Is unlawful, abusive, hateful, harassing, exploitative, sexually explicit, or otherwise unsafe
• Infringes intellectual property, privacy, publicity, or other rights
• Contains malware, tracking code, or attempts to disrupt the service

We may reject, remove, restrict, or delete content that violates these Terms, applicable law, safety rules, or provider policies.

4. Photos, Body Data, and AI Consent

Doll creation and virtual try-on require body or face reference photos. For doll creation, Clausette asks you to upload 3 to 5 photos and to give two explicit consents on the doll creation screen:

1. Consent to AI processing of your photos to create your fashion doll and virtual try-ons.
2. Consent to processing of your facial and biometric data to generate a personalised fashion doll. This data is used only for that feature and is not sold or shared with third parties.

By using these features, you confirm that:

• The photos are of you, or you have clear permission from the person shown
• You understand the photos may be processed by AI models Clausette trains, hosts, or operates itself and by third-party AI providers (see the Privacy Policy for details)
• You will not upload photos of children, strangers, celebrities, or anyone who has not consented
• You will not use AI features to impersonate, harass, deceive, or exploit another person

Clausette may create reference data such as a numerical face embedding to keep generated results consistent with your uploaded photos. You can withdraw AI processing consent and delete stored body photos plus the face reference embedding in Settings via Delete face data.

5. AI Features and Generated Content

AI outputs are generated automatically and may be imperfect, inaccurate, delayed, unavailable, or different from what you expect. Generated images may add, remove, stylise, or misinterpret clothing, body details, accessories, objects, or backgrounds. Review AI outputs before sharing or relying on them.

Clausette may try to remove hand-held objects such as phones from doll images, but we cannot guarantee every object will be removed correctly.

You may use generated content for personal, non-commercial use unless we tell you otherwise. You are responsible for how you use and share generated content.

You must not use AI features to:

• Create harmful, abusive, sexual, exploitative, hateful, or unlawful content
• Create non-consensual images of another person
• Mislead people into believing generated content is real or authentic
• Bypass subscriptions, rate limits, moderation, App Check, or security controls
• Reverse engineer prompts, models, systems, or provider integrations

6. Subscriptions and Purchases

Some Clausette features require a paid subscription. Purchases are processed through the Apple App Store or Google Play, with subscription state managed by a third-party subscription-management provider.

Subscription terms, prices, free trials, renewal dates, cancellation, and refund rules are shown in the app store purchase flow and are governed by the applicable app store terms. We never receive or store your full payment card details. Those stay with Apple and Google.

Subscriptions may renew automatically unless cancelled through your Apple or Google subscription settings before the renewal deadline. Deleting the app or deleting your Clausette account may not automatically cancel billing through the app store.

Clausette uses backend entitlement checks to decide whether paid features are available to your account. If subscription status cannot be verified, paid features may be limited until verification succeeds.

6.1 Voluntary support contributions

Clausette offers voluntary, non-recurring support contributions through your app store. Each contribution is processed as a single in-app purchase and does not auto-renew, but you may choose to contribute more than once. Support contributions are not required to use any feature, do not unlock paid features beyond a small recognition mark, and are independent of any subscription. A supporter crown appears next to your name in friend-visible places of the app as a thank-you; no other benefit is granted in exchange.

Support contributions are processed through Apple App Store or Google Play in-app purchases and are subject to those stores' refund policies. Refunds, if any, are issued by Apple or Google directly. Clausette cannot reverse, partially refund, or transfer a support contribution.

7. Social Features

Clausette includes friends, borrow requests, Style Circles, group dolls, in-app notifications, and other social features.

You are responsible for the content you share and the people you invite. Be respectful. Do not harass, spam, impersonate, shame, or pressure other users. We may restrict or remove social content, rooms, requests, or accounts that violate these Terms.

Users can block other users. Users can report others for review, and Clausette may take action where appropriate.

8. Notifications

If you enable notifications, Clausette may send push notifications and store an in-app notification inbox for the categories listed in the Privacy Policy (friend activity, borrow requests, Style Circle updates, doll-ready and try-on-ready events, OOTD nudges, streak milestones, Wardrobe Wrapped, and similar product updates).

You can manage notification preferences in the app and through your device settings.

9. Acceptable Use

You agree not to:

• Use Clausette for unlawful, harmful, deceptive, or abusive purposes
• Attempt to access another user's account or data
• Scrape, crawl, copy, or bulk extract data from the app
• Upload content intended to overload storage, AI processing, or backend systems
• Bypass paywalls, subscriptions, App Check, rate limits, security rules, or moderation
• Interfere with the service, servers, networks, models, or providers
• Reverse engineer, decompile, or attempt to discover source code except where legally permitted
• Use automated scripts or unauthorized clients to call backend functions
• Sell, rent, or sublicense access to Clausette without permission

10. Privacy

Your use of Clausette is also governed by our Privacy Policy, which explains how we collect, use, process, retain, and delete information, including photos, face reference data, AI requests, location data used for the weather card, diagnostics, and subscription status.

11. Availability and Changes

Clausette is provided on an "as is" and "as available" basis. Features may change, be delayed, be limited, or be discontinued. AI providers, app stores, our cloud infrastructure provider, subscription providers, or other infrastructure may also affect availability.

We may update, suspend, or modify the service for maintenance, safety, legal compliance, abuse prevention, scaling, or product reasons.

12. Termination

You may stop using Clausette at any time. You can delete your account in Settings via Delete account.

We may suspend or terminate access if we believe you violated these Terms, created risk for other users, attempted to abuse the service, failed to pay for paid features, or if we must do so for legal or security reasons. Examples of behaviour that may lead to suspension or termination include:

• Spam: bulk friend requests, repeated unsolicited messages, or automated submissions
• Harassment: targeted insults, slurs, threats, doxxing, or repeated unwanted contact
• Terms of Service violation: any other behaviour that breaches these Terms
• Payment fraud: chargebacks without contacting us first, stolen-card use, or refund abuse
• Safety: behaviour that puts other users or the platform at risk
• Legal request: where a law-enforcement order, court order, or applicable law requires it
• Other policy violations not specifically listed above

A suspension is a soft, reversible state. While your account is suspended you can still view your wardrobe, dolls, OOTD calendar, and other content you previously created, but you cannot create or change anything (no new OOTD logs, doll generations, friend requests, circle updates, item additions, edits, or borrows). You retain the right to export your data and to delete your account at any time during a suspension. If you believe a suspension was applied in error, contact us at account@clausette.app with your support ID (found in Settings) to appeal. For all other account questions (billing, deletion, exports), the same address reaches our account team.

Suspension and termination do not automatically cancel app store subscriptions and we do not issue refunds for unused subscription time. You remain responsible for cancelling any active subscription through Apple or Google if you want billing to stop. Settings includes a direct link to your subscription management page on the App Store or Google Play.

13. Disclaimers

To the maximum extent permitted by law:

• We do not guarantee Clausette will be uninterrupted, error-free, secure, or always available
• We do not guarantee AI outputs will be accurate, flattering, complete, realistic, safe to share, or suitable for any purpose
• Styling suggestions, fit impressions, purchase compatibility, and wardrobe insights are for general information and entertainment, not professional advice
• We are not responsible for app store outages, third-party service failures, AI provider model behaviour, or user-generated content

Nothing in these Terms limits rights you may have under applicable consumer protection laws.

14. Limitation of Liability

To the maximum extent permitted by law, Clausette's total cumulative liability for claims relating to the service or these Terms will not exceed the amount you paid to Clausette in the 12 months before the claim, or CAD $10 if you paid nothing.

We will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost data, lost profits, loss of goodwill, subscription issues handled by app stores, or inability to use AI features.

15. Indemnity

You agree to defend, indemnify, and hold Clausette harmless from claims, damages, losses, liabilities, costs, and expenses arising from your User Content, your use of the service, your violation of these Terms, or your violation of another person's rights.

16. Governing Law and Disputes

These Terms are governed by the laws of the Canadian province where Clausette is established and the federal laws of Canada applicable therein, unless consumer protection laws in your jurisdiction require otherwise.

Any dispute arising from these Terms or the service will be subject to the exclusive jurisdiction of the courts of that province, unless applicable law requires a different forum.

17. Changes to These Terms

We may update these Terms as Clausette changes. If changes are material, we will notify you through the app, by email, or by another reasonable method where required by law. Your continued use of Clausette after updated Terms take effect means you accept them.
